  1. Introductory provisions

2.1 These Terms & Conditions govern the rights and obligations of the contracting parties arising in connection with or on the basis of a purchase contract concluded between the Operator and the buyer through the e-shop.

2.2 The Operator is an entrepreneur – a sole trader (OSVČ) registered under the laws of the Czech Republic.

2.3 The buyer may be a consumer or an entrepreneur. A consumer is a natural person who, when concluding the contract, does not act within the scope of their business activity.

  1. Information about goods

3.1 The Operator offers jewelry for sale, in particular jewelry made of precious metals and jewelry set with diamonds or other precious stones.

3.2 Product descriptions, photographs, renders, and other information provided on the e-shop are for informational purposes only and correspond to standard jewellery industry specifications.

3.3 Due to the natural properties of precious metals, gemstones, and handcrafted production, minor visual variations may occur. Such variations do not affect the quality, value, or conformity of the product.

3A. Custom-made and made-to-order jewelry

3A.1 Custom-made or made-to-order jewelry means products manufactured according to the buyer’s individual requirements, including but not limited to ring size, diamond size, shape, color, clarity, metal type, engraving, or other customization.

3A.2 Custom-made jewelry is produced only after order confirmation and, where applicable, receipt of full or advance payment.

3A.3 Before production begins, the buyer may be provided with CAD designs, renders, or specifications for approval. Approval by the buyer is considered final and binding.

3A.4 Once production has commenced, the order cannot be modified or canceled, unless otherwise expressly agreed by the Operator.

  1. Conclusion of the purchase contract

4.1 All presentations of goods on the e-shop are of an informational nature and do not constitute an offer to conclude a contract.

4.2 The purchase contract is concluded upon confirmation of the order by the Operator or upon dispatch of the goods.

4.3 By submitting the order, the buyer confirms that they have familiarized themselves with these Terms & Conditions and that the order entails an obligation to pay.

  1. Prices and payment terms

5.1 Product prices are displayed in various currencies including CZK, EUR, CAD, and other currencies depending on the buyer’s selection or e-shop settings.

5.2 The price stated at the time the order is submitted is decisive.

5.3 The Operator is not a VAT payer. All prices displayed are final.

5.4 The buyer may pay the purchase price using the payment methods offered during the ordering process.

5A. Operator’s right to cancel the order

5A.1 The Operator reserves the right to cancel the order if:
a) payment is not received within the specified time,
b) the goods are unavailable or production is not possible,
c) an obvious technical or pricing error occurred,
d) fulfillment is impossible due to force majeure or circumstances beyond the Operator’s control.

5A.2 In such cases, the buyer shall be informed without undue delay and any payments received shall be refunded using the same payment method, unless otherwise agreed

5B. Advance payments for custom-made jewelry

5B.1 The Operator may require full payment or an advance payment before commencing production of custom-made jewelry.

5B.2 If the buyer cancels the order after production has begun, the Operator is entitled to retain the advance payment to cover material and production costs.

  1. Delivery of goods

6.1 Goods are delivered to the address specified by the buyer in the order.

6.2 The Operator shall dispatch the goods within the time stated in the product description or, if not stated, within 10–14 business days from order confirmation.

6.3 The risk of damage to the goods passes to the buyer upon receipt of the goods.

6A. Failed delivery and incorrect delivery details

6A.1 The buyer is obliged to provide correct and complete delivery details.

6A.2 If delivery fails due to incorrect delivery details or failure to collect the shipment, the Operator is entitled to request reimbursement of costs related to repeated delivery or return of the goods.

6A.3 In such cases, the Operator may also withdraw from the contract.

  1. Withdrawal from the contract (consumer)

7.1 The consumer has the right to withdraw from the contract without giving any reason within 14 days from the date of receipt of the goods.

7.2 Withdrawal may be exercised by e-mail.

7.3 The consumer is obliged to return the goods no later than 14 days from withdrawal.

7.4 The cost of returning the goods is borne by the consumer.

7.5 The Operator shall refund all payments received, including delivery costs, within 14 days of withdrawal using the same payment method.

7.6 Delivery costs are refunded only up to the amount corresponding to the cheapest delivery method offered.

7A. Exclusion of withdrawal for custom-made jewelry

7A.1 In accordance with Section 1837 of the Czech Civil Code, the consumer does not have the right to withdraw from the contract for goods made to order or customized according to the consumer’s wishes.

7A.2 This applies in particular to custom-made diamond jewelry, engraved jewelry, resized rings made to order, and jewelry manufactured according to specific parameters selected by the buyer.

  1. Rights arising from defective performance

8.1 Rights and obligations arising from defective performance are governed by applicable legal regulations.

8.2 The consumer may exercise rights arising from defective performance within 24 months of receipt of the goods.

8.3 Rights arising from defective performance do not apply to defects caused by normal wear and tear, improper use, or failure to follow care instructions.

8.4 Complaints may be submitted by e-mail or in writing and shall be handled without undue delay, no later than 30 days.

8A. Limitation of liability

8A.1 The Operator shall not be liable for damages caused by improper use of the goods, failure to follow care instructions, normal wear and tear, or mechanical damage after delivery.

8A.2 The Operator shall not be liable for indirect or consequential damages to the maximum extent permitted by applicable law.

8B. Diamonds and gemstones characteristics

8B.1 Diamonds and gemstones are natural materials and may contain natural characteristics such as inclusions or color variations.

8B.2 Such characteristics consistent with the declared specifications, certificates, or grading reports shall not be considered defects.

8B.3 Minor deviations in weight, dimensions, or color tone resulting from handcrafted production or gemological tolerances shall not constitute defective performance.

8C. Size and fit

8C.1 Incorrect size selection by the buyer is not considered a defect.

8C.2 Resizing may be offered for an additional fee if technically possible.

  1. Certification and authenticity

9.1 Jewelry may be delivered with a certificate of authenticity and quality issued by an independent gemological laboratory (such as GIA, IGI, or EGL) or with a certificate issued by the Operator.

9.2 Certificates represent professional opinions at the time of examination and do not guarantee future valuation.

9.3 The Operator is not liable for differences in grading opinions between gemological laboratories.

  1. Personal data protection

10.1 Personal data is processed for the purposes of order fulfillment, delivery, complaint handling, and legal obligations.

10.2 Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR) and applicable Czech legal regulations.

10.3 The buyer has the right to access, correct, delete, restrict processing, object to processing, and file a complaint with the Office for Personal Data Protection (ÚOOÚ).

10.4 Personal data is shared only with service providers necessary for order fulfillment.

  1. Out-of-court dispute resolution (ADR / ODR)

11.1 ADR authority: Czech Trade Inspection Authority (ČOI).

11.2 ODR platform: European Commission online dispute resolution platform.

11.3 The consumer has the right to initiate out-of-court dispute resolution with the Czech Trade Inspection Authority if they are not satisfied with the way the Operator has handled their complaint.

  1. Governing law

12.1 These Terms & Conditions are governed by the laws of the Czech Republic.

  1. Language versions

13.1 In case of discrepancies, the Czech version shall prevail.

  1. Final provisions

14.1 These Terms & Conditions are valid and effective as of publication and comply with applicable Czech and European Union consumer protection regulations.

  1. Retention of title

15.1 Goods remain the property of the Operator until the full purchase price has been paid.
